II 237 and Other Papyrological Evidence on Legal Pluralism in the Roman Times. Opus&nbsp;14&nbsp;(2017\/27\/B\/HS3\/01350).<\/strong><\/p>\n\n\n\n<p>Some time before 186 CE, Chairemon, an Egyptian father of the Greek cultural milieu decided to dispose of the family estate. This attempt met with a stern opposition of his daughter, Dionysia, whose benefit had been secured by a lien on the family property. The father tried to break the resistance of his obstinate offspring retorting to a legal blackmail. He applied for the procedure of&nbsp;<em>apospasis<\/em>, a privilege apparently accessible to him according to the local laws, i.e. taking-away of the unwilling daughter from her husband\u2019s house. In order to save her family-life Dionysia petitioned the Roman prefect of Egypt, debating the pretences of her father. Even if&nbsp;<em>prima facie&nbsp;<\/em>these family accusations and pretentions seem to be full of empty rhetoric and emotions (stubborn daughter, violence, inhumane law), we deal in fact with a skilful legal argument of both parties, aided by citation of numerous prior verdicts, legal opinions and prefects\u2019 edicts.<\/p>\n\n\n\n<p>The Petition of Dionysia, published almost 120 years ago (<em>P. Oxy.&nbsp;<\/em>II 237) is a unique witness of how legal pluralism functioned in Egypt: co-existence of different orders of family law: the local \u2018law of the Egyptians\u2019, the laws of the Greek settlers and the Roman legal order. A study of the papyrus allows therefore to understand how law operated in a province, but also what the level and quality of legal awareness of its inhabitants was.<\/p>\n\n\n\n<p>The research is conducted in two paths: editorial work on the text itself and its legal and historical commentary concerning both particular problems (marriage and its creation, family estate administration, securing of the interest of wives and children, paternal power, and the Roman administration of justice in the province) and more general: operation of law in Roman Egypt and the limits of the Roman tolerance towards the local systems of norms, as well as their employment in the provincial administration. The team has established new text of the document and prepared far going changes on its juridical understanding. <\/p>\n\n\n\n<p>The principal aim of the project is preparation of a new comprehensive guide to the law of Roman Egypt, intended as a case-study of the situation of Dionysia: how would a Roman judge apply the norms (and which norms co-existing in the real context of legal pluralism would he apply). Such a study will fill in the gap in the description of the legal history of Antiquity, providing for better understanding of this important source and making it more available to non-specialists.
